Dear [requester], — : | would like to request clarification regarding the need to apply fora visitor record while waiting for a second study program to start, in the context of a student who did not apply for a study permit extension within 90 days of completing their previous program and also in the scenario the student has left Canada and returned with a valid [requester] suppose that a student is planning to start a new program of study after 150 days of graduation from the previous program. In that case, we understand that the correct course of action is to apply for a restoration of status as a student (even if the study permit continues to be valid), because the completion of the previous program was over 90 days ago (AS the study permit becomes invalid 90 days after program completion as per section 222(1)(a) of the IRPR.) So there is no question regarding the need to apply for a restoration as a student instead of a study permit extension. However, in the scenario that the applicant has left Canada and returned with a valid ETA (supposedly as a returning student), would it still be necessary to also apply for a visitor record because the date of completion of the previous program and the beginning of the new program is over 150 days? This does not change whether or not the applicant is applying for a restoration of status as a student, rather than a study permit extension?
