Dear [requester], 1am emailing to obtain certainty on IRPA sections 183(4) and (5). IRPA section 183(6) indicates that, subject to a Minister's declaration, if a temporary resident has applied for an extension of the period authorized for their stay and a decision is not made on the application by the end of the period authorized for their stay, the period is extended until the day on which a decision is made or the end of the new period authorized for their stay, depending on the decision on the application. From my understanding, a TRP and work permit holder who applies to extend each before their respective expiry dates will have maintained status to continue to remain in Canada and work until a decision is made on their applications, and if they remain in Canada until those decisions are made.
