Good day,

Thank you for contacting the Immigration Representatives Mailbox.

Please note that this mailbox is intended for general guidance and does not provide responses to case-specific

inquiries but have provided the following information as guidance. Ifyou have case specific questions about a file, you

are encouraged to submit the [RCC Web form.

Please see our response to your question.

A temporary resident who applied for an extension to their period of authorized stay before it expired (e.g., before their

study permit expired [iRPR 181]) is considered to have ‘maintained their status’ as a temporary resident [|RPR 183(5)] until a

decision is made on their extension application.

* If their extension application is refused, their maintained status ends on the refusal date. ‘* If their extension application is approved, their stay continues to be authorized until the extension’s expiry date.

In-Canada holders of valid study permits are directed to apply to extend their study permit via the IRCC Secure Account.

If the temporary resident used the incorrect application (outside Canada application), they will have to leave Canada to

obtain their permit. Please note that “flagpoling” is no longer allowed for most foreign nationals. Flagpoling occurs when

foreign nationals who hold temporary resident status in Canada, leave Canada and, after a visit to the United States or St.

Pierre and Miquelon, re-enter to access immigration services at a port of entry.

Itis recommended that the applicant submit the correct application via the IRCC Secure Account with a letter of explanation, 000261
