If the PGWP extension was issued to the primary applicant prior to the January 21°* changes, the spouse may be eligible for
the pre-January 21°* requirements listed here: Family members of foreign nationals authorized to work in high-skilled
occupations (TEER 0, 1, 2 or 3) ~[R205(c){ii) ~ C41 and C46] — Canadian interest — International Mobility Program (1IMP) -

If the primary applicant's extension was approved after January 21°, the spouse would not be eligible to be assessed against
pre-Jan 21 rules
We hope this information is of assistance.
Thank you kindly,

Dear [requester],
I am writing on behalf of a prospective client, with a question regarding their work permit and their spouse's
000365
eligibility. — :
Client was issued a Post-Graduation Work Permit (PGWP) for 2 years in 2023, despite being eligible for 3 years,
due to their passport's 2-year validity at the time. Since then, my client has renewed their passport and is now
eligible to apply for the remaining duration of the work permit.
Additionally, my client's spouse was issued a 2-year open work permit based on my client's 2-year [requester], my client now works in a Teer 2 job, and with the new regulations introduced last year, their spouse
is no longer eligible for an open work permit in this role,
Given that my client's work permit was approved before the implementation of these new rules, could you
kindly clarify if their spouse would be exempt and eligible to apply for the remaining 1 year of the work permit?
Thank you very much for your time and assistance. Look forward to your response.
