Thank you for your email correspondence to Immigration, Refugees and Citizenship Canada’s Immigration Representatives

mailbox. We appreciate your patience.

Question: Let's say an inside Canada Express Entry applicant has workplace injury and cannot work but is paid for this period

through the provincial compensation board such as WSIB or [requester] points for work experience be claimed by the applicant

for this injury leave period?

Will the same apply if the applicant is outside Canada Express Entry applicant?

Lastly, can the experience also be claimed for any other type of economic class permanent residency application or work

permit application where minimum work experience is necessary and the applicant has injury during that qualifying period

but was paid for that injury leave?

Answer: Under the Express Entry system and regardless of the applicant's location, skilled work experience is accumulated

only during the hours when an applicant performs the duties listed under their occupation. For work experience to be

considered eligible, applicants must show that they performed the actions in the lead statement of the NOC job description,

and most of the main duties listed for any time claimed. Periods of leave or rest, even if those are paid leave periods, do not

count towards skilled work experience. This is outlined in the eligibility requirements, listed on IRCC’s website.

Regarding your last question, please note that we cannot provide blanket guidance on all economic programs or work permit

applications, as programs have different eligibility requirements, as outlined in the Immigration and Refugees Protection

Regulations, and on IRCC’s website. We would recommend reviewing the website, and if you still have questions, please

request guidance specific to the program you are interested in.
