Question
Under Regulation 222(1)(a.1) of the Immigration and Refugee Protection Regulations (IRPR), a study permit becomes
invalid on the day the permit holder is no longer enrolled at the designated learning institution (DL!) named in the
study permit, except when this is a result of completing their studies.
However, in situations where a study permit does not name a designated learning institution (e.g., study permits
issued prior to November 8, 2024) and the permit holder is no longer enrolled at a designated learning institution, my
understanding is that the study permit would not become invalid. Is this correct?
Answer
Ifa student is no longer enrolled at the designated learning institution (DL!) named in their study permit and does not have
the DL!'s name on their study permit, then subparagraph IRPR 222(1)(a.1) would not be applicable to them. In this case, the
student would be subject to the 90-day period after completing their studies, as outlined in subparagraph IRPR 222(1)
(a)
