Question:
Our HSWP client has an open work permit valid to 2 years. Her accompanying dependents include her spouse and 2
kids who were under 22 when the application was submitted, but are 23 and 25 now. The PA is trying to get her 6
months work experience to finalize PR but it is taking longer than expected. All PR docs have been submitted (including
medicals, IMM56695, etc) prior to the Home Support Worker WP issuance, as part of the required process.
The spouse and kids want to apply for work permits under C91. This section says spouses and kids are eligible, I’m just
concerned because they are older than 22 now.
Does lock-in for PR include lock-in for temporary residence also?
Response;
R2 defines a dependent child as such:
‘As dependent child, in respect of a parent, means a child who
+ (a) has one of the following relationships with the parent, namely,
© (i) is the biological child of the parent, if the child has not been adopted by a person other than
the spouse or common-law partner of the parent, or
© (ii) is the adopted child of the parent; and
+ (b)is in one of the following situations of dependency, namely,
© (i) is less than 22 years of age and is not a spouse or common-law partner, or
© (ii) is 22 years of age or older and has depended substantially on the financial support of the
parent since before attaining the age of 22 years and is unable to be financially self-supporting
due to a physical or mental condition. (enfant d charge)
For temporary residence purposes, the dependent child must meet the above requirement when we receive their work
