Question:

am writing to inquire whether Canadian work experience gained while working for an abusive employer will count towards

CRS points in an application for PR under Express [requester], if the principal applicant was brought to Canada under an

FTA work permit to work in a restaurant in Canada as a chef but upon arrival was assigned to a different restaurant with the

same ownership. The principal applicant, in good faith, filed a claim against the employer within 6 months of arriving in

Canada and was issued an open work permit under the vulnerable worker program.

Can the applicant use the work experience gained for the abusive employer towards CRS points in Express Entry?

Answer:

The applicant may claim the work experience they obtained while on the FTA work permit as long as that work experience

meets the requirements listed under section 15 of the Ministerial instructions and they are able to provide the evidence that

they performed the main duties of the job they are claiming points for.

Please be advised that the assessment of an application is based on a case-by-case basis; each application will be considered

on its own merits, with a final decision based on a review of all the information available to the officer at the time of

decision. The onus is always on the applicant to provide sufficient documentation to satisfy an officer that they meet the

requirements.
