For LMIA-exempt work permits, intra company transferee/Canadian interests, there is a requirement to be working for the employer for at least 1 year to claim the job offer points. The instructions on the IRCC website say “under any work permit”. For intra-company transferees, can they claim the job offer points if they have been working for the same employer outside Canada for more than one year? Answer: This scenario is described in subparagraph 29(2)(a)(iii) of the Ministerial Instructions respecting the Express Entry system. Please note that the Ministerial instructions specify that to be assigned points for arranged employment in such scenario, one year of work experience for the employer named on the work permit must be obtained over a continuous period of work in [requester] for the same employer outside Canada for more than one year does not meet the requirements as outlined in the Ministerial instructions.
