If you have case specific questions about afile, you are encouraged to submit the IRCC Web form Please see our response to your question Question: Scenario If someone was working remotely from Canada with a foreign employer, and were to declare this foreign work experience and that person was also working in Canada with a Canadian employer and met the criteria to declare that work experience as [requester] they claim foreign work experience (s. 25) to be assigned points under s. 23 and s. 24 of the Ministerial instructions AND claim the Canadian work experience (s. 15) to be assigned points under s, 15 of the same Ministerial Instructions? ‘The question is asking whether a person can declare and be awarded points for simultaneous foreign and Canadian work experiences where the foreign work is performed by the worker for a foreign company remotely while they are living in Canada with status and work authorization Answer: Remote work for a foreign employer while residing in Canada may be eligible to be awarded Comprehensive Ranking System (CRS) score as foreign work experience under the skill transferability points if it meets all the requirements. The applicant may claim concurrent work experience for two full-time jobs: one in Canada and one performed remotely outside [requester] on the applicant's qualifications the system may grant them CRS skill transferability points for foreign work experience and CRS core points for Canadian work experience at the same time. The system will not grant additional Federal Skilled Worker program selection criteria points for work experience in excess of 30 hours per week Please note that the system does not currently capture remote work. Please make sure to select the Country/territory of the employer when claiming remote work performed from [requester] the applicantis invited to apply, please submit an explanation detailing the remote work agreement, and where the employer and employee are physically located ‘The assessment of an application is based on a case-by-case basis, considering the particular circumstances in conjunction with the supporting documentation available to the officer. Question: | am requesting an interpretation of the Ministerial Instructions respecting the Express Entry system in cases where remote skilled (NOC 0,4,8) work experience is gained while performed with a foreign employer, reporting to work at a foreign/overseas location (not a Canadian location}, while the foreign national is in [requester] that this is my third attempt to receive a response since December 10, 2020. According to the current Ministerial Instructions 25 (1) For the purposes of sections 23 and 24, foreign work experience is work experience that (a) is acquired by a foreign national outside Canada in one or more occupations listed in Skill Type 0 Management Occupations or Skill Level Aor B of the National Occupational Classification matrix; (b) consists of full-time work experience, or the full-time equivalent for part-time work experience, with one or more employers; (clis acquired within the 10-year period preceding the day on which points are assigned to the foreign national under section 23 or subsection 24(1); and (d) is remunerated by the payment of wages or a commission. In other words, | am trying to determine what “acquired by a foreign national outside Canada’ means. QUESTION 2 (only if Question 1is NO) Ifit does not constitute foreign work experience, and assuming no other eligibility factors or criteria, would this work experience be considered Canadian work experience in the ministerial instructions, s. 15(3)(a)? 15... (3) For the purposes of this section, Canadian work experience is work experience that (a) is acquired by a foreign national in Canada in one or more occupations listed in Skill Type 0 Management Occupations or Skill Level A or 8 of the National Occupational Classification matrix; 1am hoping for some clarity on the meanings of inside Canada/outside Canada in the ministerial instructions in cases of remote work, and! understand that there are other factors involved to determine whether the candidate would be awarded points. Answer: Remote work fora foreign employer while residing in Canada may be eligible under the Express Entry as foreign work experience if it meets all the other requirements. Work outside of the Canadian labour market is not eligible as Canadian work experience. Please be advised that the assessment of an application is based on a case-by-case basis, considering the particular circurnstances in conjunction with the supporting documentation available to the officer. The onus is always on the applicant to provide sufficient documentation to satisfy an officer that they meet the requirements.
