Question:

I would like an opinion on a case that has come up at our institution. We had an exchange student come for and complete a 4-

month exchange program (Sept-Dec. 2024). They studied without a study permit under the exemption for programs 6 months

or less. This same student now wants to participate in a second exchange program next year (Sept-Dec. 2025). The student has

returned their home country and is studying at their home institution between these exchange programs. They will be

outside Canada for 9 months between programs,

Question: Can this student come back to Canada and take the second short program without a study permit under the

exemption for programs that are 6 months or less?

Response:

Regulation 188(1)(c) stipulates that a foreign national may study in Canada without a study permit if the duration of their

course or program of studies is six months or less and will be completed within the period for their stay authorized upon

entry into [requester], subsequent short term studies in Canada require a study permit even if the program of study is

less than 6 months. Student must apply outside Canada and obtain a study permit in the normal manner (for example, at a

Canadian visa office abroad). Website
