Iwas wondering if you could clarify the following regarding CRS points through the Express Entry system:

1. Cana foreign national receive CRS points for “Canadian Experience” if they are working in Canada for a Canadian incorporated company that does not have a physical premise in Canada? The foreign national is physically working in Canada, but he does so remotely on behalf of his Canadian employer.

Answer: A foreign national may receive CRS points for Canadian work experience, provided that the work experience meets the requirements outlined in section 15 of the Ministerial Instructions respecting the Express Entry system. Skilled work experience must have been gained by working in Canada while authorized to work under temporary resident status. If work was done remotely, the applicant must have been physically in Canada and working for a Canadian employer. The policy intent for Canadian work experience requires that the work performed demonstrates to the Officer that the applicant has entered the Canadian labour market, and a Canadian entity paid the applicant for their work. It must also be evident to the Officer that the work would be considered a business activity that is competitive in the Canadian labour market, and that this position would normally have been filled by a Canadian citizen or permanent resident. When an applicant is invited to apply, we would recommend submitting an explanation, detailing the work agreement, and where the employer and employee are physically located.

2. Can the same foreign national receive CRS points for “Arranged Employment”? I understand CRS points for Arranged Employment is about to change, but until it does, can the foreign national claim Arranged Employment points if they have
