Would students who started at a new post-secondary DLI in September 2024 but who did not complete the DLI transfer

process at that time now be considered non-compliant under the new regulations? Would these students now be required to

discontinue their in-progress studies pending approval of.a new in-Canada study permit application?

Response 1

The regulations apply as of November 8, 2024. Ifa student changed institutions before this date and did not notify IRCC, they

would not be held to the new requirements. However, they must have a valid study permit. Ifthe student now needs a study

permit extension to complete their program, they began at the new DLI before November 8, they will need to submit a Provincial

Attestation Letter (PAL) with their extension application.

Ifa student started a program at a new DLI in January 2025 but failed to submit their study permit extension to change DL, are

they considered non-compliant and must stop studying now? Or, can they submit a study permit extension at this time and

continue their classes in the current term? If they can submit an extension, will a PAL be required?

Response 2

Students who started a program at a new DLI in January 2025 but did not submit their study permit extension are considered

non-compliant. They must stop studying until they submit a study permit extension. They can submit the extension application

now and continue their classes once it is approved. A PAL will be required with the extension application if they are extending

their studies at a new DLI and new level of study.

Per previous guidance received from IRCC and industry partners CBIE (Nov 22):

Question: Would students who started at a new post-secondary DLI in September 2024 but who did not complete the DLI otesa

Response: The regulations only apply as of November 8. Ifa student changed institution prior to that date, even ifthey did not notify IRCC, they would not be held to the new requirements, However, in all cases the student must have a valid study’ permit in hand. © Inthe above situation, if the student now needs a study permit extension to complete the program they began at the new DLI before Nov 8, will they be required to submit a PAL with this extension application? DLI Changes & student non-compliance: Per the DLI change policies in effect from Nov 8, if'you were accepted to a new DLI for the Winter or Spring 2025 semester (starting fiom January 1, 2025 to May 1, 2025). You can start studying at your new DLI if your have been accepted to a DLI for the Winter or Spring 2025 semester (starting from January 1, 2025 to May 1, 2025), and have applied for a study permit extension, and have a study permit that remains valid and that doesn’t have the DLI name printed on it, and meet all your existing study permit conditions + Ifa student started a program at a new DLTin Jan 2025 but failed to submit their study permit extension 10 change DLI (because they were unaware of the policy change), are they considered non-compliant and must stop studying now? Or, can they submit a study permit extension at this time and continue their classes in the current term? If they can submit an extension, willa PAL be required? PGWP eligibility and leave from studies: For college students, per the PGWP field of study eriteria in effect flomNov 1, ifa student applied for ther inal stady permit before Nov | PGWP eligibility will be grandfathered in. Those applying for study permit on or after Nov I must meet the new field of study criteria Scenario - A student applied for an inital study permit before Nov 1 for a PGWP eligible program. They completed 1 year of this PGWP eligible college diploma program. Then they took leave from studies for 1 year during which time their study permit expired while they were outside [requester] return to Canada and complete their studies they must now submit a new study permit application from outside Canada. © will heir PGWP eligibility be locked-in based on that initial pre-Nov 1 study permit date? Or, will hey be considered as a post-Nov 1 "new" study permit applicant, meaning that PGWP eligibility will be based on completing a program from an eligible field of study?
