Proof of having Temporary Protected Status issued by the hosting state where the foreign national is residing is an acceptable document under the EMPP (accompanied by a durable solution information form) however, proof of being in another country substantiated by entry stamps on a passport is not. If a candidate does not have an eligible status document, they can work with one of our EMPP non-government partners to assess if they are eligible as a refugee or displaced person before they apply. While we do not respond to case specific questions, please note that each case will be assessed by an officer considering the particular circumstances in conjunction with the supporting documentation available to them. Some foreign nationals residing outside their country of nationality for fear of persecution may have ended up in countries that do not offer national framework for refugee protected, nor provide any temporary protection documents but simply suspend deportations of such individuals to their country of persecution. In effect, these individuals would not have any document to substantiate their temporary status which they could use as TPS and fill out durable solutions form to be eligible for the Federal EMPP program, They fled their country of persecution and the host country reached a verbal agreement to suspend their deportations. My question is whether these individuals could provide proof of their temporary stay in the form of all pages of their passport showing entry stamp to the host country in lieu of a TPS document and provide the completed durable solutions 001363

form to substantiate their protection need. This assumes that their temporary stay in the host country albeit without formal documentation finds its basis on their protection need.
