Please see our response to your question: ‘A Canadian citizen or permanent resident of Canada may sponsor 1 relative if they meet all of these conditions: * *are related to them (the relative they wish to sponsor) by blood or adoption *don't have a living relative they (the person who wants to sponsor their relative) could sponsor instead, such as a: © * spouse © * common-law partner © * conjugal partner © *son or daughter © *parent © * grandparent © * orphaned sibling © * orphaned nephew or niece © * orphaned grandchild © * don’t have any relatives (aunt, uncle, or any of the relatives listed above), who is a © * Canadian citizen © * permanent resident © * registered Indian under the indian Act A potential sponsor with a living parent cannot sponsor them under the “other relative” category due to having a living parent who they could sponsor instead. A relative cannot be considered a member of the family class as per paragraph 117(1) (h} of the Immigration and Refugee Protection Regulations (IRPR) if the sponsor has other living relatives they could sponsor instead, such as a parent. Asa parent can be sponsored under the parents and grandparents (PGP) program, as prescribed in paragraph 117(1)(c) of IRPR, the potential sponsor must apply under that category to sponsor their parents instead. The intent behind the other relative category is to provide an avenue towards family reunification for Canadian citizens and permanent residents who have no other relatives they may sponsor instead as members of the family class under paragraphs oot4s3
