A change in personal situation can refer to any of the following: marital status, birth of a child, death of a spouse or other dependent, criminal convictions, change of employer, etc. Ifa principal applicant dies, a surviving in-Canada accompanying dependent who wishes to pursue permanent residence may submit a written request to IRCC along with supporting documents (e.g., copy of a death certificate) ~ requesting that their application continue to be processed, on H&C considerations. The applicant is responsible for making sure that all circumstances and factors that they wish to have considered are provided, This must include any hardship they believe they will suffer if you are not granted the exemption(s) they are requesting. Dear [requester], Jam an immigration lawyer working at a non-profit for low-income individuals in 1am contacting you to find out whether it is possible for an in-Canada dependent (adult) on an H&C application to become the principal applicant on the same H&C application if the original principal applicant dies? Would IRCC agree to maintain the same H&C application and allow the remaining dependent a window of time to submit additional supporting evidence and any extra forms completed?
