Under the Immigration and Refugee Protection Act (/RPA) and Regulations (IPR), study permit holders in Canada must meet a number of conditions including (but not limited to) enrolling at the designated learning institution (DLI) that is named in their permit and remain enrolled there until they complete their studies; and actively pursuing their course or program of study. The information highlighted in your request regarding is at recognition that a study permit holder may be required or wish to take leave from their studies while in [requester] provision that any leave taken from a program of studies in Canada should not exceed 150 days from the date the leave commenced and must be authorized by their DLI is a consideration when officers are assessing whether or not a study permit holder is actively pursuing their studies. Note: As of November 8, 2024, students who wish to change DLIs at the post-secondary level need to get a new study permit by applying to extend their current one. Applications are assessed on a case-by-case basis. Study permit holders may be required to provide evidence to an officer of their compliance with their study permit conditions (R220.1(4); this includes to Canada Border Services Agency (CBSA) officers at a port of entry (POE). When an officer is assessing an application:

© * In cases where a study permit holder has taken multiple periods of leave in Canada during their program of study (towards a Canadian credential) an officer may consider the applicant’s reasons for the various periods of leave. If the multiple periods of leave do not appear to support the expectation that the study permit holder is making reasonable progress toward the completion of a Canadian credential, an officer may determine that they have not fulfilled their study. permit condition to actively pursue their course or program of study.

# * An officer may also assess the reasons why a study permit holder has changed institutions or programs of study a number of times. Where multiple program or institutional changes do not appear to support the expectation that the study permit holder is making reasonable progress toward the completion of a Canadian credential, an officer may determine that the study permit holder has not fulfilled their study permit condition to actively pursue their course or program of study,

We hope this information is helpful “ernest sino Regards, [requester] De Envoyé: [requester] A: Immigration Representatives / Représentants immigration (IRCC) <[IRCC Immigration Representatives mailbox]> Objet: [requester] Dear [requester]/[requester] name is Ihave some questions and appreciate your valuable insight. According to IRCC website, "There are a few cases where you may be able to take a leave of up to a maximum of 150 days from your program of studies and stil! be considered to be actively pursuing your studies." Our first question is mainly with regards to the highlighted section above which says, "from your program". Q1: If they change programs, will these 150 days reset? Example: Student took 150 days leave during his previous program, then changed DLI and started another program ‘Will he be able to take another 150 days off during the new program? Q2: Ifa student leaves Canada does the 150 days still apply? That is to say, if they leave and return after more than 150 days, will they be able to resume their studies with the same study permit which is still within its expiry date? Example: Student left Canada January 1, 2024, and wants to come back for January 2025 intake resuming his studies while his study permit has not expired yet (expiry is September 2027). Can the student return with his valid visa and this study permit? Thank you for your time and attention to this matter! [NAME REDACTED] 01621
