Upon fixrther review of your request, we identified that it may in reference to the Temporary public policy to facilitate the issuance of an open work permit to certain former or current post-graduation work permit holders that was signed on April 14, 2022. If this is correct, the application of the public policy would have been different ffom the previous response provided to your question. Please note that we are unable to provide case specific information, However, in general, itis important to note that status and authorization are two separate things under the Immigration and Refugee Protection Act and its regulations. The email notice providing the interim work authorization (TWA) under the 2022 public policy would have only allowed the individual to work at the time until the expiration date on the leter. Please note that it does not restore legal temporary resident status ifthe person's status expired. It was intended to ensure that those with expired and expiring post-graduation work permits could work while they waited for an updated or new open work permit Generally, once a refusal letter for a work permit is received, foreign nationals are no longer authorized to work under R186(u) and are advised of this in the refusal letter, however the PGWP public policy provided a separate authorization to work independent of R186(u). \sb240If the individual's work permit application was refused, the individual would be considered out of status, and they must have applied to restore their status.
