© * My clientis an international student whose study permit allows up to 24 hours of work per week while studying.

# * He is currently working part-time as an Uber driver and is seeking confirmation on how IRC defines work hours for future immigration applications, specifically when applying for a post-graduation work permit (PGWP) or other work permits.

* * Uber records two types of hours:

1. 1. Online Hours: The time the driver is available on the Uber app but has not accepted a ride (not actively working or earning wages). 2. 2. Active Hours: The time the driver is completing a ride request—driving to pick up the passenger, waiting, and dropping them off (earning wages). According to IRCC’s guidelines, work hours are calculated based on time spent earning wages, receiving wages for performing a service, or collecting a commission for providing a service. My client is only paid for active hours, so he has been tracking only active hours as his official work hours. However, there is no clear official confirmation from IRC on whether: Only active hours (hours actually worked and paid for) will be considered, OR Both online and active hours (even the time simply being logged into the app) will be counted. Request for Offical Clarification: We kindly request a clear, written response to the following: Will IRC count only “active hours" (the hours my clientiis actively working and earning wages) when assessing work history for future immigration applications, or will it also consider "online hours" (when my client is available on the Uber app but not earning wages)?
