Subsection R183(5) grants an extension of the period of authorized stay by operation of law, allowing a foreign national to maintain their temporary resident status. So a student who applies for an extension of their study permit before it expires, would have temporary resident status until a decision is made on that application. However, R183(5) does not automatically authorize a temporary resident to continue working while their application for a renewal of their permit is in progress. Itis clear to me that under section R189, a foreign national who has made an application under subsection 217(1) is authorized to study without a study permit until a decision is made on the application if they have remained in Canada since the expiry of their study permit and continue to comply with the conditions, other than the expiry date, set out on the expired study permit.
