‘The Updated temporary public policy for nationals of Iran in Canada as temporary residents (TPP) is intended to support

Iranian nationals who arrived in Canada on or before February 28, 2025 (the date that the previous TPP ended), and who have

maintained their temporary resident status. Having said that, the TPP does not stipulate that the foreign national must have

continuously remained in Canada since their arrival on or before February 28, 2025.

Question 1: If an individual first entered Canada before February 28, 2025, obtained a work permit under the IRAN2023 policy,

but was outside Canada at the time of this policy change, would they still be eligible to apply under the updated policy upon

their return to Canada with a valid work permit? Response: If an individual first entered Canada on or before February 28, 2025, and obtained a work permit under the IRAN2023 policy, they would still be eligible to apply from within Canada under the updated policy, provided that they have been authorized to re-enter Canada as a temporary resident. An individual applying for a work permit, a work permit renewal, or for a study permit under this TPP must be in Canada with valid temporary resident status at the time of application and when a decision is rendered. However, applicants may leave Canada while their application is pending, or between applications. Continuous physical presence in Canada is not required to maintain eligibility.

Question 2: If the answer to Question 1is yes, how would the policy apply to someone who first entered Canada before

February 28, 2025, but never obtained or applied for any permit under this policy before leaving Canada? Would they still be

eligible to apply under the updated policy upon their return? Response: If an individual first entered Canada before February 28, 2025, but never obtained or applied for any permit under the IRAN2023 policy before leaving Canada, they may still be eligible to apply from within Canada under the updated policy, following their re-entry to Canada as a temporary resident, depending on the circumstances of the case. The updated policy supports Iranian nationals who arrived in Canada on or before February 28, 2025 and who hold valid temporary resident status, regardless of whether they had previously applied for a permit under the IRAN2023 measures. Having said that, officers will review these applications on a case-by-case basis to ensure that the applications meet the intent of the TPP. in addition to any supporting documents provided by the client with their application, IRCC leverages the Entry/Exit Program with the Canada Border Services Agency to confirm whether clients meet the eligibility criteria of the public policy.

Please note: A foreign national who leaves Canada no longer holds valid temporary resident status and must present

themselves at the port of entry where a decision will be made whether to permit re-entry as a temporary resident. Visa-

required foreign nationals who leave Canada and wish to come back must hold a valid temporary resident visa to be able to

travel back to Canada.
