Please refer to the quide for Instructions before completing these questions. As you mention, Sections 133(2) and 133(3) of the Immigration and Refugee Protection Regulations (IRPR) outline exceptions to the sponsorship bars included in Sections 133(1}(e) and 133(1)(f} of the [requester], there may be situations where a sponsor responds “yes” to question 14 under the Sponsor Eligibility Assessment section of the IMM 1344, but may not be barred from sponsoring their family member(s). In such situations, they may still submit an application to sponsor their family member and their eligibility to sponsor will be assessed on a case-by-case basis based on the facts and information available. Additionally, we recognize that the IMM1344 form does not include space for sponsors to provide additional details regarding convictions if they have answered “yes” for question 14. In such cases, we recommend that the sponsor provide details in the box below question 18 that states, “If you answered ‘yes’ to question 13, 16, 17, or 18, please provide details including date and place.” In addition to including the date and place of the conviction(s), sponsors should also include details regarding any pardons or acquittals issued in relation to the applicable convictions. If there is not enough space in the box provided, please include any additional details in a separate letter of explanation. We are in the process of updating the !MM1344 Instruction guide and we will be reviewing the sections you have highlighted to ensure they are clear and reflect the instructions above as well as align with the IRPR We will also take note of the issues you have raised and take them into consideration when we complete our next update of the IMM1344 form.
