[requester] I would like to clarify whether self-employed work experience gained in Canada can be counted towards the Federal Skilled Worker Program (FSWP) under Express [requester] my understanding: © Self-employed work experience obtained in Canada with proper authorization can be considered for eligibility criteria (67 points ) under the FSWP, as outlined in seetion 75(2)(a)(b)(c) of the Immigration and Refugee Protection Regulations, assuming it meets all the other conditions. The Reglementation does not specify that the work experience for the eligibility purpose must be acquired outside Canada and shall not be acquired as selfemployed. In fact, we have helped many selfemployed clients aboard to obtain PR under this program in the past.

© However, this experience cannot be used for CRS scoring;*neither as foreign work experience nor as Canadian work experience, as per the Ministerial Instructions.

Could you confirm so?

Additionally, can work hours as an employee and as self-employed during the same period be combined to meet the 30-hour

perweek requirement?

For exampk,, ifa French teacher who has an open work permit in Canada works 20 hours per week as an employee and,

during the same week, she works 10 hours per week as a self-employed worker for the same school under the same

conditions, can this be counted as 30 hours per week for eligibility purposes?

Response:

There is no requirement that an offer of employment made under the Francophone mobility program be partetime or all-time

However, the employer must ensure that they comply with all other regulations set out in the Immigration, Refiigee and

Protection Regulations and the provincial and territorial labour laws of the province or territory in which the employment will

be performed.
