Dear [requester],
Ihope this message finds you well.
Ihave a general question regarding the eligibility of spouses of Post-Graduation Work Permit (PGWP) holders for an open
work permit.
According to the information provided on the following IRCC webpage:
htws://www.canada.ca/en/immigration-refugees-citizenship/services/work-canada/permit/temporarv/open-wark-permit-
spouses-devendent-children/apply.html
under the section "Spouses or common-law partners of high-skilled workers who are not on a pathway to permanent
residence", it states
"if your spouse is applying for an open work permit at the same time as you (the principal applicant), the spouse
doesn’t need to provide proof of the length of time you can or will be legally authorized to work in Canada."
Based on this, | would like clarification regarding the following:
If the PGWP applicants eligible for a 12-month work permit, can their spouse still apply for a spousal open work permit if
both applications are submitted together? Or does this guideline only refer to the fact that the spouse does not need to
provide proof of the PGWP holder's authorization to work at the time of submission, but the requirement of the principal
applicant holding a work permit of at least 16 months still applies?
Thank you in advance for your clarification. | look forward to your response,
Kind regards,
